BACKSTORY BACKDROPS SERVICE AGREEMENT, WAIVER, & RELEASE FROM LIABILITY

Reservations

  1. ​Signed Service Agreement and 50% nonrefundable deposit is required to hold rental items and event Service Date. Deposit will be applied to final bill and balance will be due 14 days before Service Date.  The rental items and Service Date are not reserved until signed Service Agreement and Deposit is submitted to and received by Backstory Backdrops LLC. ​​

  2. Remainder payment is to be paid in full 14 days prior to Service Date

  3. Custom Designed items are paid in full 30 days prior to Service Date.

  4. If you add to any order, additional Deposit and or payment amount may be needed.

  5. There is a $400 rental minimum (not including delivery, and taxes).

​Order Changes ​

  1. Final changes to item counts need to be placed at least 14 days prior to Service Date

  2. Items and Services added to your order within 14 days of the Service Date are subject to Rush Order Fees.

  3. Final changes to Custom Designed items at any time after Final Approval may be subject to Change Order Fees.

​Cancellations​

  1. Deposits are non-refundable. Deposits can be applied towards a different date if you need to cancel or reschedule as long as you give us 72hrs notice. 

  2. Cancellations made within 72hrs of the Service Date will be charged the full rental with no option to reschedule.

  3. Additional charges may apply if the order has been loaded and/or in route.

  4. Cancellation of Custom Designed items any time after Final Approval is not refundable. Payments can be applied towards a different date for the same items if you need to reschedule.

 

 

General Weather Policy

  1. Customer will be given the option to cancel reservation up to 48hrs prior to delivery/setup on days where severe weather is forecasted at delivery location. All deposits will remain as credit that can be used within a 6-month period.  

  2. Cancellations due to weather made within 48hrs of the Service Date will be charged the full rental with no option to reschedule.

  3. In instances where severe weather condition(s) arises during or after delivery/setup, Backstory Backdrops LLC has the right to end the reservation/rental term and no refund will be given.

 

Bounce House Policy​​

  1. WEATHER: Severe weather conditions can pose hazards for the safe operation of the inflatable. Our policies below outline the treatment of our inflatables when encountering such unfavorable weather conditions as well as normal weather policies.

    • Customer will be given the option to cancel reservation up to 48hrs prior to delivery/setup on days where severe weather is forecasted at delivery location. All deposits will remain as credit that can be used within a 6-month period.  

    • Cancellations due to weather made within 48hrs of the Service Date will be charged the full rental with no option to reschedule.

    • In instances where severe weather condition(s) arises after delivery/setup, Backstory Backdrops LLC has the right to end the reservation/rental term and no refund will be given.

    • In instances where severe weather condition(s) arises during or after delivery/setup, Backstory Backdrops LLC has the right to end the reservation/rental term and no refund will be given.

      • Wind - Even though we secure our inflatables properly, we will not be able to set up in winds 20 mph or more for the safety of you and your guests. In the event of increased wind during your rental; have all jumpers exit the inflatable and deflate it until the wind dissipates before inflating and re-entering.

      • Rain-If the inflatable gets wet have all jumpers exit the inflatable and deflate until the rain stops and the unit is dried. Please unplug and move blower out of the rain. THE INFLATABLE MUST NOT BE USED WHEN WET. Once wet, inflatables can become very slippery and dangerous. Once the rain stops you can dry the unit with towels ensuring the bounce house is dry before having jumpers re-enter.

  2. INFLATABLE RULES​: It is the responsibility of the person or organization hiring this inflatable equipment to ensure that all possible precautions are taken to avoid injury to people or damage to the Inflatable.
    Please ensure that the following safety instructions are followed:

    • Responsible adult supervision is always required. Never let jumpers, parents or guest intimidate you. The Jumper's safety is your foremost concern. NEVER LEAVE THE INFLATABLE UNATTENDED.

    • Do not mix age groups.

    • Ensure children are not pushing, colliding, fighting, or behaving in a manner likely to injure or cause distress to others.

    • No flips 

    • Keep children away from stakes, blower, and power cords.

    • Do not allow anyone to bounce on the front safety step.

    • Do not allow jumpers to play or climb on outside walls.

    • Do not allow jumpers to jump if inflatable is wet.

    • Do not allow jumpers to jump in instance of severe weather.

    • In case of winds greater than 20mph. or lightning, remove riders and unplug unit.

    • Remove shoes before entering inflatable.

    • Do not pull, hang on or climb on pillars.

    • In case of loss of power or air remove riders immediately. 

    • In the event the blower stops working, please ensure all jumper get off the inflatable immediately. Check your breaker(s) and make sure the blower tube or deflation tube has not come undone or something has not blown onto and is obstructing the blower. In the event it overheats, or loses power, switch the blower off at the mains, then switch it back on again 2-4 minutes later, and it should restart. If it does not, inform us immediately at 210-504-7279.

    • Do not allow anyone to be on the inflatable equipment during inflation or deflation, as this is highly DANGEROUS and could result in injury or death.

    • NO FOOD, DRINKS in the inflatable.

    • NO BUBBLES in or near inflatable. Bubbles can cause the inflatable to be slippery and unsafe for jumpers.

    • ABSOLUTELY NO GLITTER, FACE PAINT, SILLY STRING, COLORED STREAMERS, SMOKE BOMBS, PARTY POPPERS, SHARP OBJECTS in or near the inflatable. Please note these products will cause irreparable damage to the inflatable and Customer will be liable for replacement for $4,500.)

    • NO smoking in or around the Inflatable.

    • No Pets, TOYS OR SHARP OBJECTS in the inflatable- if damage occurs to the inflatable Customer will be liable for replacement for $4,500)

    • No excessive weight. Max. Maximum Weight of each group that should play in the bouncer at one time is: For 13 x13 bouncers, Maximum weight of 800 LBS; For 15 x 15 bouncers, Maximum weight of 1000 LBS; For slide maximum weight under 250 LBS.

    • Moving an attraction after final set-up will be assessed an additional $100. Please make sure our team understands any concerns you may have with the positioning of the attraction before they get started.

    • We love to bounce, but when it comes to safety, we don't play. We take our clients and jumpers safety very seriously. Backstory Backdrops LLC has the right to add Customers that break any of the for mentioned rules to a "DO NOT RENT" list. 

  3. SETUP

    • Ground-inflatables must be secured on level ground: grass, asphalt, concrete, or indoors. Customer will ensure the set-up location is free of all sticks, rocks, animal waste, or any other objects that could damage the bounce house. We do not setup on gravel, rocks, dirt or sand. 

    • Power Supply - A dedicated plug, must be within 75’ of setup location for the inflatable blower.

  4. Pick up will occur right at end of contracted time, or up to 1 hour after depending on traffic, success of other picks-ups, etc. Inability to enter via a security gate after 30 minutes is grounds for rental cancellation and your payment will not be refunded. Inability to access a security gate for pickups will result in the Customer's responsibility to properly break down the inflatable and all of its components, in addition to a $650 overnight fee and a $100 trip fee for next day pick up. Any damage caused to the inflatable during the extended stay will be at the liability of the Customer.

  5. If the inflatable equipment is lost, stolen, stained, or damaged beyond repair, the Customer agrees to pay $4,500.00 (four thousand five hundred dollars and 0 cents) for a replacement inflatable. The damaged inflatable will remain property of Backstory Backdrops LLC.

  6. Customer agrees to release, forever discharge and hold harmless Backstory Backdrops LLC, its officers, employees and/or agents from any injury, damages or claims resulting out of or in connection to severe weather conditions and/or Customer’s negligence to follow rules noted in Bounce House Policy.

Additional Terms and Conditions ​(Applies to all Rentals and Services)

  1. Inability to enter via a security gate after 30 minutes is grounds for rental cancellation and your payment will not be refunded.

  2. Customer must have rental items ready for pick up on the date and by time specified on invoice.

    • Pick up will occur right at end of contracted time, or up to 1 hour after depending on traffic, success of other picks-ups, etc.

    • Inability to access a security gate for pickups after 30mins will result in the Customer's responsibility to properly take down all rentals and their components and properly store them, in addition $100 return trip fee and for some items a $500 overnight fee.  Any damage caused to rentals during the extended stay will be at the liability of the Customer.

  3. Customer agrees not to loan, sublet, or otherwise depose of equipment.

  4. The rental equipment has been received in good condition and will be returned in the same condition.

  5. The Customer is responsible for loss or damage of items and will pay for the cost of                   replacement or repair.  This cost will be assessed within 5 days of return and presented in a separate invoice payable within 15 days.  

  6. Customer agrees to pay in full the cost, including labor, for all damages to rental equipment.

  7. If the inflatable equipment is lost, stolen, stained, or damaged beyond repair, the Customer agrees to pay $4,500.00 (four thousand five hundred dollars and 0 cents) for a replacement inflatable. The damaged inflatable will remain property of Backstory Backdrops LLC.

  8. Customer agrees to ensure that all users (and users’ guardians) of the rental equipment sign liability waivers.

  9. For safety reasons, stakes & sandbags are used to support some rentals. Customer is responsible for selecting location, and any damage incurred to sprinklers, pipes, cable etc. will be customer’s responsibility.

  10. Backstory Backdrops, LLC shall not be held responsible for any grass damage.

  11. Backstory Backdrops, LLC shall not be held responsible for any type of unfavorable weather conditions, rain or high winds, electrical outages, hurricanes or other acts of God.

  12. Backstory Backdrops reserves the right to cancel the reservation or end rental term at any time. Client will receive full refund immediately upon company cancellation if not related to severe weather or outlined setup conditions

  13. ​The Customer will inform Backstory Backdrops, LLC of any adornments (decorations, signs etc.) of any kind they wish to add on their own to any rental. This information may be added in the notes section of the quote request form or submitted in writing no less than 72 hrs. before the date of the event. Failure to do so will result in a $100 charge. 

  14. ​There is no warranty that rented items are free of defects.

  15. This contract and agreement shall be in accordance with and governed by the laws of the State of Texas.

  16. The person(s) or organization acquiring services from Backstory Backdrops, LLC will be held responsible and liable for all damage or injury occurring for any reason whatsoever.

  17. ​The Customer agrees to and shall indemnify and hold harmless and defend Backstory Backdrops LLC, its employees and third-party contractors hired by Backstory Backdrops LLC from and against any and all claims, losses, damages, causes of action, suits and liability of every kind, including all expenses of litigation, court costs and attorney's fees, for injury to or death of any person, or damage to any kind of property, or for any breach of contract arising out of or in connection with this rental agreement and the purposes for which this  rental agreement was entered into, including but not limited to property damage, injuries and death due to the act, omission, mistake, fault, default, or negligence of (1) Backstory Backdrops LLC its employees and third-party contractors hired by Backstory Backdrops LLC (2) the Client, its agents and employees; and (3) any invitees, licenses or guests of  the Client. 

  18. In the event that the release and hold harmless as contained herein is held unenforceable for any reason, Customer herby agrees to a limit on any damages claimed by Customer to the total paid to Backstory Backdrops, LLC for the rental.

  19. Customer agrees to reimburse Backstory Backdrops, LLC for all attorney fees, an amount not less than 100% of all sums due, court cost and expenses incurred by Backstory Backdrops, LLC to enforce collection or to preserve or enforce rights under this contract.
